Legal Separation
An order of legal separation (“separate maintenance”) does not terminate the marriage, but the parties may have all of their rights regarding property, spousal support, custody and child support adjudicated in this proceeding. The grounds for filing an action for separate maintenance are the same as those for a divorce action. Nevertheless, if a party later wishes to dissolve the marriage, she must file for divorce.
